Welcome to Kairos. Please read these Terms of Service (“Terms”) carefully before using the Kairos mobile application (“App”) operated by Kairos (“we”, “us”, or “our”).

By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You represent and warrant that you are an individual of legal age to form a binding contract (or if not, you have received your parent’s or guardian’s permission to use the App and have gotten your parent or guardian to agree to these Terms on your behalf) through our Parental Consent process.

We do not knowingly collect or solicit personally identifiable information from children under 13 (if such child is located in the United States) or under 16 (if such child is located in the European Union or United Kingdom) (in each case, a “Child under the Age of Consent”) without obtaining verifiable consent from that child’s parent or guardian (“Parental Consent”), except for the limited amount of personally identifiable information we need to collect in order to obtain Parental Consent (“Required Information”). Until we have received Parental Consent, we will only use Required Information for the purpose of obtaining Parental Consent. If you are a Child under the Age of Consent, please do not attempt to register for or otherwise use the App or send any personal information about yourself to us before we obtain Parental Consent, except for the Required Information in the context of the Parental Consent process.

If you believe that a Child under the Age of Consent may have provided us with personal information without our obtaining Parental Consent, please contact us at support@downloadkairos.com.

2. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your account credentials.
  • Promptly update your information if it changes.
  • Accept responsibility for all activity that occurs under your account.

You may not share your account with others, create multiple accounts, or transfer your account to another person without our prior written consent.

3. Description of Service

Kairos is a Catholic education app that provides:

  • Short, structured theology lessons based on the Catechism of the Catholic Church.
  • Daily Scripture verses.
  • Progress tracking and streaks.
  • An AI-assisted Q&A feature (“Ask Kairos”) that provides responses informed by Catholic teaching.

Content within the App is intended for educational and devotional purposes. It is not a substitute for professional spiritual direction, pastoral counseling, or theological advice from ordained clergy or certified catechists.

4. Subscriptions and Payments

4.1 Free and Paid Features

Kairos offers both free content and premium features available through paid subscription plans.

4.2 Billing

Subscriptions are billed through the Apple App Store or Google Play Store (“Platform”). By purchasing a subscription, you agree to the pricing and payment terms presented to you at the time of purchase. All payments are processed by the applicable Platform.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Platform account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

4.4 Cancellation

You may cancel your subscription at any time through your Platform account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the period for which you have already paid.

4.5 Refunds

Refund requests are subject to the policies of the applicable Platform (Apple App Store or Google Play Store). We do not directly process refunds.

4.6 Price Changes

We may change subscription prices from time to time. Price changes will take effect at the start of the next billing period following notice to you. If you do not agree with a price change, you may cancel your subscription before the change takes effect.

5. User Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws.
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the App.
  • Copy, reproduce, redistribute, or create derivative works from any content in the App.
  • Use automated systems, bots, or scrapers to access the App or extract content.
  • Interfere with or disrupt the integrity or performance of the App or its servers.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Harass, abuse, or harm another person through your use of the App.
  • Attempt to circumvent any access restrictions, security measures, or usage limits.

6. AI-Assisted Features

6.1 Nature of AI Responses

The “Ask Kairos” feature uses artificial intelligence to provide responses informed by Catholic teaching and Sacred Scripture. AI-generated responses are educational in nature and may not always be perfectly accurate or complete.

6.2 Not Authoritative Teaching

AI responses do not constitute official Catholic doctrine, magisterial teaching, or pastoral guidance. For matters of faith and morals, users should consult the Catechism of the Catholic Church, Sacred Scripture, and qualified clergy.

6.3 Usage Limits

We may impose reasonable limits on AI feature usage to manage costs and ensure service quality.

7. Intellectual Property

7.1 Our Content

All content, designs, graphics, software, and other materials in the App (“App Content”) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App Content without our prior written consent.

7.2 Scripture Texts

Scripture texts used in the App may be sourced from public domain translations or licensed from third parties. Specific translation attributions, where required, are provided within the App.

7.3 Catechism References

References to the Catechism of the Catholic Church (CCC) are used for educational purposes. The Catechism is the intellectual property of the Libreria Editrice Vaticana.

8. Account Deletion

You may delete your account at any time through the App settings. Upon account deletion:

  • Your personal information will be deleted in accordance with our Privacy Policy.
  • Your progress and usage history will be permanently removed.
  • Any active subscription should be cancelled separately through your Platform account settings to avoid continued billing.

We will process account deletion requests promptly and in accordance with applicable law.

9. Disclaimers

THE APP AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

KAIROS IS AN EDUCATIONAL TOOL AND DOES NOT REPLACE PARTICIPATION IN THE SACRAMENTS, FORMAL CATECHESIS PROGRAMS, OR PERSONAL SPIRITUAL DIRECTION.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFIT OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kairos, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App and updating the “Last Updated” date. Your continued use of the App after the effective date of any changes constitutes your acceptance of the Updated Terms. If you do not agree with any changes, you must stop using the App and delete your account.

13. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the App will immediately cease.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kairos regarding your use of the App and supersede any prior agreements.
