Kairos (“we”, “us”, or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Kairos mobile application (“App”). Please read this policy carefully. By using the App, you consent to the practices described in this Privacy Policy.

1. Information We Collect

1.1 Information You Provide Directly

  • Account Information: When you create an account, we collect your name, email address, phone number, date of birth, and password (or authentication credentials if you sign in through a third-party service such as Apple or Google).
  • Profile Information: Optional information you choose to provide, such as a display name or profile preferences.
  • User-Generated Content: Questions or prompts you submit to the “Ask Kairos” AI feature.
  • Support Communications: Information you provide when contacting us for support, including your name, email address, and the content of your communications.

1.2 Information Collected Automatically

  • Usage Data: Information about how you interact with the App, including lessons completed, quiz responses (aggregated), streaks, session duration, and feature usage.
  • Device Information: Device type, operating system and version, unique device identifiers, and language settings.
  • Log Data: IP address, access times, app version, and crash or error reports.

1.3 Information We Do NOT Collect

  • We do not collect precise geolocation data.
  • We do not collect biometric data.
  • We do not collect financial or payment information (payments are processed entirely by the Apple App Store or Google Play Store).
  • We do not access your contacts, camera, or microphone.

2. How We Use Your Information

We use the information we collect to:

  • Provide and maintain the App, including delivering lessons, tracking your progress, and powering the AI Q&A feature.
  • Personalize your experience, such as recommending lessons or displaying relevant content based on your learning progress.
  • Communicate with you, including sending service-related notifications (e.g., streak reminders, lesson updates) and responding to your inquiries.
  • Improve the App, by analyzing usage patterns, identifying bugs, and developing new features.
  • Ensure security, by detecting, investigating, and preventing fraudulent or unauthorized activity.
  • Comply with legal obligations, including responding to lawful requests from public authorities.

3. AI Feature Data

When you use the “Ask Kairos” AI feature:

  • Your questions are sent to a third-party AI service provider (currently OpenAI) to generate responses.
  • We do not use your AI interactions to train AI models.
  • AI conversation data may be retained temporarily for service improvement and quality assurance, and is deleted in accordance with our data retention practices.
  • Our AI service providers are contractually prohibited from using your data for their own purposes beyond providing the service.

4. Data Sharing and Disclosure

We do not sell, rent, or trade your personal information. We may share your information only in the following circumstances:

4.1 Service Providers

We share data with trusted third-party service providers who assist us in operating the App, including:

  • Authentication services (e.g., Supabase) for account management.
  • AI service providers (e.g., OpenAI) for the Ask Kairos feature.
  • Analytics services for understanding App usage and performance.
  • Push notification services for delivering notifications.

These providers are contractually obligated to use your data only as necessary to perform services on our behalf and to maintain appropriate security measures.

4.2 Legal Requirements

We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court order or government agency).

4.3 Business Transfers

In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice within the App of any change in ownership or use of your personal information.

4.4 With Your Consent

We may share your information for other purposes with your explicit consent.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with the App. Specifically:

  • Account data is retained until you delete your account.
  • Usage data is retained in aggregated, de-identified form for analytics purposes.
  • AI conversation data is retained for up to 30 days for quality assurance, then deleted.
  • Support communications are retained for up to 2 years after resolution.

Upon account deletion, we will delete or de-identify your personal information within 30 days, except where retention is required by law.

6. Data Security

We implement industry-standard technical and organizational measures to protect your personal information, including:

  • Encryption of data in transit (TLS/SSL) and at rest.
  • Secure authentication and access controls.
  • Regular security assessments of our infrastructure.

However, no method of electronic transmission or storage is 100% secure. While we strive to protect your personal information, we cannot guarantee its absolute security.

7. Your Rights and Choices

7.1 Account Management

You may access, update, or correct your personal information at any time through the App settings.

7.2 Account Deletion

You may delete your account at any time through the App settings. Upon deletion, your personal information will be removed in accordance with Section 5 above.

7.3 Notifications

You may opt out of push notifications at any time through your device settings. You may manage email notification preferences within the App.

7.4 California Residents (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, including:

  • Right to Know: You may request information about the categories and specific pieces of personal information we have collected about you.
  • Right to Delete: You may request that we delete your personal information.
  • Right to Correct: You may request that we correct inaccurate personal information.
  • Right to Opt-Out: We do not sell or share your personal information for cross-context behavioral advertising. If this practice changes, we will provide a “Do Not Sell or Share My Personal Information” mechanism.
  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

7.5 European Economic Area, UK, and Swiss Residents

If you reside in the EEA, UK, or Switzerland, you may have additional rights under the General Data Protection Regulation (GDPR) or equivalent laws, including the right to access, rectification, erasure, restriction of processing, data portability, and the right to object to processing. 8. Personal Data of Children

The Children’s Online Privacy Protection Act (“COPPA”) requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 13. Moreover, the EU General Data Protection Regulation (the “GDPR”) requires that data controllers obtain consent from the holders of parental responsibility over children who are under 16 years of age before such controllers knowingly collect and process Personal Data from such children.

We do not knowingly collect or solicit personally identifiable information from children under 13 (if such child is located in the United States) or under 16 (if such child is located in the European Union or United Kingdom) (in each case, a “Child under the Age of Consent”) without obtaining verifiable consent from that child’s parent or guardian (“Parental Consent”), except for the limited amount of personally identifiable information we need to collect in order to obtain Parental Consent (“Required Information”). Until we have received Parental Consent, we will only use Required Information for the purpose of obtaining Parental Consent. If you are a Child under the Age of Consent, please do not attempt to send any Personal Data about yourself to us before we obtain Parental Consent, except for the Required Information in the context of the Parental Consent process.

We do not knowingly use or disclose Personal Data of any users that we know to be a Child under the Age of Consent for behavioral advertising.

If you believe that a Child under the Age of Consent may have provided us with personal information without our obtaining Parental Consent, please contact us at support@downloadkairos.com. If we become aware that we have collected personal information from a Child under the Age of Consent without verification of Parental Consent, we will take steps to delete that information promptly.

9. Third-Party Links and Services

The App may contain references or links to third-party websites or services. This Privacy Policy does not apply to third-party services, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party services you access.

10. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence, including the United States. These countries may have data protection laws that differ from those in your jurisdiction. By using the App, you consent to the transfer of your information to the United States and other countries where we or our service providers operate.

Where required by law, we use appropriate safeguards (such as standard contractual clauses) to protect your information during international transfers.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy within the App and updating the “Last Updated” date. We may also notify you via email or push notification for significant changes. Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Privacy Policy.
